Definitions of Law
1.1 The Equipment shall mean goods, components or other items hired or sold by ESS Hire (2016) Limited.
1.2 The “Customer” is the person, firm, corporate or public body, hereafter referred to as “You” or “The Customer”, hiring or purchasing the Equipment.
1.3 The “Company” is ESS Hire (2016) Limited hereafter referred to as “ESS Hire” “Us” “We” or “The Company”
2.1 The charges due are as stated and agreed on the quotation.
2.2 Hire charges commence from the date stated in the quotation and are payable for the period of hire. Late return of equipment will incur additional hire costs for the period of time until the equipment is returned.
2.3 All equipment must be returned in a clean and serviceable condition. A cleaning or repair cost may be made at the discretion of the company.
2.4 All spares, tools and other additional equipment supplied with the hire, must be returned, or the customer will be charged in full for their replacement.
2.5 Any legal or other charges incurred in the recovery of money or of equipment shall be paid by the customer.
2.6 All charges are payable on demand and failure to meet payment terms will result in any discounts given being lost and interest will be charged at the standard rate.
3.1 The hire period commences and terminates at the times specified and agreed in the quotation.
3.2 Changes to the hire period must be agreed by ESS Hire and will be subject to stock availability.
4.1 A cancellation fee is charged, for any cancellation of hire from 60 days of the hire date at 50%. For cancellation of hire from 14 days or less of the hire date the full cost of the hiring will be charged.
6.1 The customer’s responsibility for the equipment commences on receipt of the equipment, and terminates when equipment is returned or collected.
6.2 It is the customer’s responsibility that everyone who uses the equipment has been instructed in its safe and proper operation, and further will not allow the equipment to be misused.
6.5 ESS Hire can not be held liable for any financial loss or loss of business caused by equipment failures or failure to supply equipment or services in any circumstances.
6.6 The equipment must not move from the site specified in the contract without prior authorisation from ESS Hire
6.7 Commentary boxes must not be towed or moved without prior authorisation from ESS Hire.
6.8 It is the customers sole responsibility to ensure that any equipment on hire is kept free of moisture, liquid or any other contaminants that could damage the equipment.
6.9 It is the customers sole responsibility to ensure that adequate security measures are put in place to ensure the safety of our equipment and personnel at all times.
7.1 It is the customers responsibility to provide suitable means of access for our vehicles onto and around the site as required. If this results in our vehicles going “off-road” the customer is responsible for any subsequent recovery of the vehicle plus any additional costs accrued.
7.2 It is the customers responsibility to make suitable parking arrangements at the venue for our vehicles for the time that our crew are to be on site for both the delivery-erection and dismantling-collection. Where penalty costs are incurred due to the lack of suitable arrangements these will be passed on to the client as an additional charge.
7.3 Suitable clear unrestricted access is required for our vehicles to the area immediately adjacent to where the equipment is to be sited. There will be additional charges levied where this is not possible.
8.1 Any electrical equipment should be used with plugs and/or sockets as fitted.
9.1 The customer shall not act to compromise the serviceability of the equipment during the hire period.
9.2 Any breakdown or unsatisfactory working of equipment shall be immediately notified to ESS Hire.
9.3 Under no circumstances shall the customer attempt to repair the equipment without prior authorisation from ESS Hire.
9.4 If request an engineer to come to site and the fault is found to be user error then a call out fee will be charged.
10.1 The customer agrees to pay the Company the full replacement cost of any equipment lost, stolen or damaged beyond economic repair (without deduction for usage, wear and tear, or age).
10.2 The customer shall insure the equipment against the above liability. Insurable value of equipment will be provided by ESS Hire on request.
Termination of hire
11.1 ESS Hire shall be entitled to terminate the contract with immediate effect and to repossess the equipment at any time if the customer is in breach of these terms.
11.2 Such termination shall not affect the right of ESS Hire to recover from the customer any money due under the contract, consequential loss or damages for breach.
11.3 The customer authorises ESS Hire to enter onto any property upon which they reasonably believe any equipment to be, and at the absolute discretion of ESS Hire, the equipment may be recovered and removed.
12.1 All times stated for delivery are approximate. We will not be liable for any delays caused by circumstances beyond our control.
12.2 We will not be liable for any indirect loss, loss of business, profits, discounts, wasted money, wages, fees or expenses due to late delivery, non-delivery, unsuitability, breakdown or stoppage of the goods or any part of them.
13.1 We reserve the right to make reference to and to use recorded media detailing any work undertaken by us for the sole purpose of publicity of the Company without obtaining further permissions.
Acceptance of terms
14.1 All work undertaken or services provided or goods hired from ESS Hire shall be subject to these conditions and the hirer by authorising or allowing work to proceed or goods to be delivered is deemed to have confirmed the contract and to have accepted these conditions. Further more by accepting these terms, the customer personally indemnifies and guarantees payment in the event of the corporate body, organisation or other body being unable to pay any outstanding monies owed for whatever reason.
15.1 The equipment shall at all times remain the absolute property of ESS Hire and the hirer shall have no rights to the equipment.
15.2 Any discounts given can be withdrawn without notice if payment terms are not met.
16.1 The use of equipment outdoors is subject to weather conditions. We reserve the right to take all necessary precautions to safeguard personnel and equipment if the weather conditions demand such action and without any penalty to ourselves. This could include the non-installation, amended installation or lowering of structures or equipment. The decision as to the correct course of action will be made by our staff whilst on-site and taking into account all of the factors available.
